Terms of Service

1. Agreement to Terms

By accessing or using Finance IQ ("Service"), operated by Finance IQ ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. Users who access the Service on behalf of a company or other legal entity represent that they have authority to bind that entity to these Terms.

2. Description of Service

Finance IQ provides an AI-powered financial reporting and analytics platform that connects to Oracle NetSuite to generate dashboards, reports, and AI-driven financial insights. The Service is provided on a subscription basis.

3. Subscriptions and Billing

3.1 Free Trial. We offer a 7-day free trial on your first instance. No payment is required during the trial. After the trial, your subscription will automatically convert to a paid plan unless cancelled.

3.2 Subscription Fees. Subscriptions are billed monthly per NetSuite instance. Current pricing is available on our Pricing page. We reserve the right to change fees upon 30 days' notice.

3.3 Payment. Payments are processed securely by Stripe. By providing payment information, you authorise us to charge the applicable fees to your payment method.

3.4 No Refunds. All fees are non-refundable except as required by applicable law or as expressly stated otherwise.

3.5 Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Access another user's account or data without authorisation
• Attempt to probe, scan, or test the vulnerability of our systems
• Transmit any viruses, malware, or other harmful code
• Scrape, crawl, or use automated means to access the Service
• Reverse engineer, decompile, or disassemble the Service
• Resell or sublicense the Service without our written consent
• Use the Service to process data you do not have the right to process

5. Your Data and Privacy

5.1 You retain ownership of all data you upload to or generate via the Service ("Your Data"). By using the Service, you grant us a limited licence to process Your Data solely to provide the Service.

5.2 We will handle Your Data in accordance with our Privacy Policy.

5.3 You are responsible for ensuring you have all necessary rights to share data with us and that doing so complies with applicable laws, including data protection regulations.

6. Intellectual Property

6.1 The Service and its original content, features, and functionality are and will remain the exclusive property of Finance IQ and its licensors.

6.2 Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Finance IQ.

6.3 AI-generated content produced by the Service on your behalf is assigned to you, subject to Section 5.1 of our AI Terms.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Financial data and AI-generated insights are provided for informational purposes only and do not constitute professional financial, accounting, or legal advice.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Finance IQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business, or goodwill, arising out of or in connection with these Terms or your use of the Service.

Our total liability to you for any claims arising under these Terms shall not exceed the amount paid by you to Finance IQ in the twelve months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Finance IQ and its officers, directors, employees, and agents from any claims, damages, obligations, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

10.1 We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or for any other reason at our sole discretion.

10.2 Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

10.3 You may delete your account at any time from your account settings.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Finance IQ is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice in the Service at least 30 days before the changes take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
